Successful management of mediation and arbitration proceedings can lead to an optimal resolution of disputes of various kinds, and can also help shorten proceedings and save time and costs for the parties.

Managing arbitration and mediation proceedings requires knowledge, experience, and the ability to see the full range of considerations, complexities, and different layers of the dispute at hand in the alternative proceeding, and accordingly allows for creative solutions — including those that cannot be reached in traditional proceedings before judicial courts. The attorneys at our firm are appointed as arbitrators and mediators both by bodies such as the Israel Bar Association, the Registrar of Cooperative Societies, and the Kibbutz Movement, and in response to voluntary applications by parties and their representatives.

Our Mediation and Arbitration Department strives for effective resolution of disputes across a wide range of fields, drawing on knowledge and skills accumulated over many years of managing legal proceedings, including through alternative means. Mediation and arbitration proceedings are part of the mosaic of legal solutions offered at our firm, including litigation services and expertise in the fields of real estate and planning and construction, public and administrative law, local authorities, cooperative societies, and more. The broad legal scope aids in understanding the interests of all parties, leads to a comprehensive picture, and enables us to strive to find the best solution through creative means.

The attorneys in the department have a unique specialization in managing proceedings involving cooperative societies and/or members of such societies. Accordingly, we have the knowledge and familiarity with all the issues and proceedings unique to the field of internal relations within cooperative societies, between the society and its members, and vis-à-vis third parties outside the society. This includes proceedings involving issues between a society and its members, including departing members and members whose membership has lapsed, engagements with kibbutz/moshav members and/or third parties in various contracts, issues related to lifestyle change proceedings, kibbutz bylaws, asset and apartment allocation, demographic growth and absorption, construction, pensions, nursing care, special needs, and more.
